PAYE (Pay tax As You Earn)

All individuals applying for any temporary positions through an employment agency who intend to work on a PAYE basis are captured by the EAA regulations which means that in order for an agency to provide you work seeking services the following are required:

  1. Proof of identity - for example a copy of your passport, recent P45, valid EU driving licence, birth certificate etc
  2. Proof of your legal entitlement to accept a job, if offered. e.g. a copy of a passport together with any valid work permit or visa.
  3. Proof of your qualifications, technical or educational, which confirm that your skills and experience match any technical requirements of the role which specify formal qualifications are required.

Limited Company

Since the announcement of the EAA Regulations, the industry trend in the IT and general professional sector appears to be that the majority of limited company contractors are electing to 'opt out' of these new regulations - this legitimate option forms part of the new legislation. In order to opt out you will need to acknowledge your acceptance of our terms and conditions both as an individual and on behalf of your limited company or in the case of an umbrella company an appropriate signatory of the umbrella company is also required.

Benefits of Opting Out

Opting out of the Regulations may be looked upon favourably as one of the indicators that may help to increase the possibility that your contract will fall outside of the IR35 legislation.

Speed of service, as we will not need to process your personal details in the same way, prior to commencement of any assignment.

Sometimes a higher rate may be offered to contractor's who opt out to reflect the reduced administration and risk.

If however, you decide you wish to remain within the scope of the Regulations through your Limited Company, the facts we require from you before we are able to provide services to you are:

  1. Acknowledgement of your acceptance of our terms and conditions both as an individual and on behalf of your limited company or in the case of an umbrella company, an appropriate signatory.
